Public Hearing

  • Marco called the public hearing to order at 7:30.

PZC2015-17 Application for Modification to existing approved special permit and site plan at 350 Ruby Road and 328 Ruby Road Owners: FedEx Ground Package Systems, Inc. and Ruby Associates General Partnership (Received April 7, 2015 Public Hearing June 2, 2015 ~continued decision within 65 days after close of P.H.)

Attorney Dorian Famiglietti was present for the applicant.  She asked if W. Parsell and P. Nevers had reviewed the tapes from the previous public hearing and they said they had.  She said all changes have been made to the plan but the town engineer has not had a chance to finalize his review.  

Paul Brand said he received comments from the town engineer and gave a recap of the underground detention system.  He said they made the following revision based on the town engineer’s comments, the commission’s comments and North Central Conservation District's recommendations.  

  • The system was moved 50 feet from the retaining wall.
  • They ran new calculations based the use of extreme precipitation data and upsized some of the pipes; they system will still hand the flows of a 100 year storm.  
  • Notes and controls have been updated to handle the phasing of the project.
  • Hay bales were added to the backing.
  • A temporary outlet and rip rap pad were added.
  • The gravel drive will now have a perforated drain to collect run off; the underdrain will be installed in the center of the driveway.
  • An oil grid separator has been added.
  • Adjustments have been made to the snow removal plan; the issues have been clarified.
Mr. Brand said if there is a significant storm as there was this year, they will have ample area for snow storage.  

Mr. Brand said the existing shed for mixing sand and calcium chloride has been added.  In regards to the lighting plan, he said they lowered the wattage to 750 watts which will help to decrease the spread of the lights and the lighting will be full cut-off.  

Atty. Famiglietti referenced Greg Tocci’s sound study and said back alarms are exempt by OSHA if the alarms are required.  

Atty. Famiglietti said the Assessor has updated the field card to included Ms. Parizek name and she has sent a certified notification to her and her name has been added to the plan.  

S. Yorgensen asked if the conservation easement had been added to the plan and Mr. Brand said that it had.  

Mr. Brand explained the detailed workings of the plan as presented at the previous public hearing and added that the isolator row will be the first step in taking out debris. He said the cleaning details have also been added to the sheet.  

Atty. Famiglietti agreed to grant an extension and asked if the commission would deliberate if they close the public hearing on July 21st.  A. Marco said he doesn’t believe there are any obstacles that would keep the commission from voting.  

P. Nevers questioned the cleaning of the system and S. Yorgensen said they can ask for copies of the maintenance plan and the logs.  

Further discussion was held on the engineers report and keeping the public hearing open.  A discussion was held on the maintenance plan and S. Yorgensen asked if there were specs on the vortex unit; Mr. Brand said yes.  

The Public Hearing was continued to July 21st.  

R. Tulis said he would like to reiterate the desire to have screening along the top of the retaining wall; he has concerns that the trees between bottom of the retaining wall and the pond, along the sides visible from the road, will be starved for water and may not survive.  

R. Tulis said simply because ZBA granted a variance does not require the PZC to go along with it – it simple allows them to approve something that would normally be contrary to the Regulation.

Atty. Famiglietti said ZBA does have the legal authority to alter the regulations to permit a variance from the strict requirements of the regulations and has to go with a 10 foot buffer.  
A discussion was held on the fences and Mr. Brand said they are wind bearing fences so they cannot put slats on them.  

Regular Meeting

PZC2015-15 Requesting determination of Boundary Line Adjustment (vs. Subdivision) at 350 Ruby Road and 328 Ruby Road Owners: FedEx Ground Package Systems, Inc. and Ruby Associates General Partnership

This application was tabled to the next meeting.

PZC2015-23 Requesting waiver of Public Hearing for Special Permit (Section 13) the location was previously used for retail store 14 Tolland Turnpike (Map 30 Lot 13 Zone DC) Owner: Chase Realty LLC Applicant: Louise Hanson (Received June 16, 2015 Public Hearing or decision by July 21, 2015)

Louise Hanson was present and said she would like to sell refurbished furniture and home décor at 14 Tolland Turnpike.  S. Yorgensen said the location previously had a special permit for retail sales and said there cannot be any changes in the parking.  The Commission agreed that a public hearing is not necessary as it falls under the previous permit.  

E. Standish motioned to waive the public hearing.  The application falls under the previously issued special permit and shall have all the same requirements.  D. Roberts seconded the motion.  All in favor.  Motion carried.  

PZC2015-24 Sign application for 327 Ruby Road (Map 42 Lot 45 Zone DC) Owner: TA Properties Trust Applicant: CT Sign Service (Received June 16, 2015 Public Hearing or decision by July 21, 2015

John Morrison of CT Sign Service was present for the applicant and presented the plan.  He said they would like to install a blue fabric awning and move the signs which will in turn reduce the square footage of the signage.  He said the lights will be LED.  A discussion was held.  E. Standish said he believes this is a minor modification with improvements and the commission agreed.  

E. Standish motioned to approve the application as submitted.  W. Parsell seconded the motion.  All in favor.  Motion carried.  

Old Business

D. Roberts motioned to approve the minutes of June 2, 2015.  E. Standish seconded the motion.  All in favor.

Letters to Chairman Marco from Ms. Cook and Ms. Plude regarding the potential of the State Police training facility.

Staff Report and Discussion

A discussion was held on the proposed gun range.  A. Marco read through the PoCD and a discussion was held on the criteria of the PoCD.  A discussion was held on traffic.  Selectman Mailhos joined the Commission, as ex-officio member, at the table for discussion.  She said they want a 55,000 square foot facility and 4 outdoor ranges.  A discussion was held on the pros and cons and the environmental study.  A. Marco asked the commission to read through the PoCD and would like to revisit this at the next meeting.  

S. Yorgensen updated the Commission on the status of the violations, Willington Oaks, River Road and Wilderness Way.
